Terms of Service

First let us say that we want happy, satisfied customers; we know our success depends on you recommending us to your friends. We understand that it is far more costly to find a new customer than to retain an existing customer. With that in mind, if you feel that our stated policies are in some way working against you, PLEASE contact us and let’s discuss it.

Your Responsibilities

  • Please work with us to understand your needs, problems, and expectations; we can’t exceed your expectations unless we know what they are.

  • If your system is serviced in our shop, please provide us with the various pieces of hardware you want us to integrate into your system, e.g. a LCD monitor, printer, camera, PDA, network disk, etc.

  • Provide us with both the CD, and license (Product-Key), for any existing software and/or application programs that you already own and want integrated into your system (we can acquire and integrate any additional software you want to add). If you are running a Microsoft operating system, for instance Windows, a label containing the product key is usually attached to your computer.

  • It is your responsibility to backup any personal data and software on your system prior to our commencing service; we are not responsible for loss or corruption of any data or software that may occur in the course of our services and we are not prepared to guarantee the integrity or validity of data transfers. We strongly recommend that you authorize us to create, and provide to you, a full backup of your system prior to beginning our work, and again after completing our work.

  • If you ask us to stop work prior to completion, you are responsible for paying for the portion of the parts and labor we have already expended on your behalf.

  • Payment is due in full upon completion, or cancellation, of the work and signifies your acceptance of the services rendered.

All this said, remember that our services are guaranteed (see the warranty terms below), and our goal is your complete satisfaction. We will always strive to earn the right to do business with you again.

Our Responsibilities

  • Prior to beginning any work, we will provide you with a statement of the work to be done, an estimate of the cost, and obtain your approval.

  • During the course of our work, if we become aware of any additional costs that are required to complete our work, we will stop work, give you a new estimate, and obtain your approval prior to recommencing work.

  • We will acquire the highest quality, and lowest cost parts and software, consistent with your time constraints. Obtaining parts locally (immediately) often costs substantially more than if you are willing to wait for delivery of items so we can obtain them at near-wholesale prices.

  • During our service work, and at completion of our work, we will provide you with recommendations, i.e. things we believe you should consider that will improve the performance and reliability (e.g. anti-virus, data backup) of your systems.

  • We will work with you to assure you are completely satisfied with your experience with Affordable Computing Northwest. If for any reason you aren't satisfied, please let us know so that we can address the issue.

Terms of Warranty and Service

Warranty – Parts & Labor:

  • We will always use the best parts available, from respected manufacturers, and reputable suppliers, and we will strive to acquire them at the lowest price. Parts we use in your system carry the manufacturers warranty; if a part fails within the manufacturer’s warranty period, we will obtain a new one for you under the manufacturer’s warranty program, charging you only what the manufacturer charges for the replacement, e.g. shipping costs. We will return the failed component(s) to the supplier for exchange and will work to expedite the replacement.

  • Labor to replace failed components that we supplied in the course of our work is free for 180 days; after that time, normal labor rates apply. This is double the industry standard replacement-parts policy of 90 days (computers, printers, TVs, etc.).

Warranty – Labor & Services:

  • Services we have performed are guaranteed for 30 days from the day you take possession (see below). We recommend that you allow us to provide you with a full backup of your system (on DVD). As a first step in resolving a problem, we may ask you to restore the system from this backup, to assure the system configuration is the same as when it was returned to you.

  • Services performed under our warranty will be performed at no cost to you, at the same location where the original service was performed, e.g. at your site or in our shop. For services we originally performed at your site, at our discretion, we may require that you allow us to take your system components to our shop if we feel a more in-depth analysis is required.

  • Once you are a customer, we want to keep you as a customer. We will bend over backwards to extend the warranty for our services well beyond the terms stated above, unless we determine the failure is due to abuse. For instance, if you are downloading illegal programs that in turn spread viruses, that is abusive and beyond our control. If you have opted to allow us to do a full backup of your system, there should be no issue. If a problem occurs, we can quickly restore your system to the same state as when it left us (at no cost to you).

Parts Ordered for you:

  • If your system is not in our shop, and you request us to order parts that are unique to your system, e.g. a screen for your specific laptop, a 100% deposit on the cost of the item is required before we can order it.

  • If you decide you do not want an item you authorized us to order for your system, and the supplier will restock it, the money you paid for the item will be refunded to you, minus any shipping, handling, travel, and restocking costs related to acquiring and returning the item. If the supplier will not restock the item you authorized us to order, we cannot refund the amount you were charged for the item.

Shipping:

If you request items be shipped to you, title to the items, and risk of loss, passes to you upon delivery of the item(s) to the carrier (we recommend insuring any items shipped to you).

Payment for Services:

If the customer has a balance due for parts and/or services rendered, any computers, peripherals, and/or parts related to those services shall become the property of Affordable Computing Northwest 30 days after delivery of written notice to the customer via certified mail.

In the case of NSF checks (aka bounced checks), under Oregon law, when maker fails to tender amount due after written demand made by payee, payee may recover damages in an amount equal to $100 or triple the amount for which the check, draft or order is drawn, whichever is greater, provided the amount is not greater than $500 over the due amount.

Abandonment:

Affordable Computing Northwest is not liable or responsible for any computers, peripherals, and/or any other items left on our premises 30 days after the customer has been notified that service has been completed. Thirty (30) days after the customer has been notified, these items will be considered abandoned and shall become the property of Affordable Computing Northwest.

General Terms and Conditions:

To the extent permitted by law, you agree that Affordable Computing Northwest’s total liability for damages related to or caused by items and services we provide, or as a result of such item’s or service’s failure to perform, is limited to the total amount you paid for the services and items, and you release Affordable Computing Northwest from liability for any indirect, incidental, special, or consequential damages.

In case of the failure of a hardware or software product supplied to the customer by Affordable Computing Northwest, the customer’s sole remedy is limited to the warranty terms of the manufacturer of the item. In the case of a failure of a service supplied by Affordable Computing Northwest, the customer’s sole remedy is limited, at Affordable Computing Northwest’s discretion, to Affordable Computing Northwest re-performing the services and correcting the problem, or a refund not to exceed the original price of the service. Shipping, handling, delivery, and travel charges, and the cost of parts and products purchased by Affordable Computing Northwest for the customer, are not refundable.

Except and to the extent expressly set forth above, there are no warranties, expressed or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose and Affordable Computing Northwest expressly disclaims all warranties not stated herein. Some states or provinces do not allow the exclusion of implied warranties or limitations on how long an implied warranty will last. Therefore, the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

Affordable Computing Northwest reserves the right to change published prices without prior notice. The prices charged for a job will be the prices that were published and in affect the day your system was dropped off or on-site work began.

Legal invalidation of any portion of these Terms of Service and Warranty does not invalidate any or all remaining portions of these Terms. Affordable Computing Northwest reserves the right to modify or alter its warranty and return policies at any time, without prior notice to customers.
